Conditions of participation

Registration:
You can register for a tour/event in person, by phone or in writing. With your registration you conclude a contract with us. This contract becomes binding upon acceptance of the booking confirmation (written or oral).

Scope of services:
The scope of the contractual services can be found in the booking confirmation. In the absence of a written confirmation, the scope of services or price stated in the brochure shall apply.Withdrawal by the customerYou can withdraw from the event at any time. In your own interest and to avoid misunderstandings, we recommend that you declare your withdrawal in writing. Up to 8 days before the scheduled date, there are no cancellation fees. From the 7th day before the scheduled date, 30% cancellation fees will apply. In case of no-show on the day of the event, the cancellation costs are 100%.

Unused services:
If the event participant does not use the booked services - for whatever reason - then in principle no refund of the price paid will be made. In case of timely notification of hardship cases (illness, accident, etc.) that lead to the non-arrival of the tour, it is at our discretion to award vouchers for the individual services. If the event participant does not start the tour at the agreed time or does not start it on time, there is no claim to a refund of the price paid.

Rebookings:
If the services are rebooked, the customer bears the additional costs.

Withdrawal & termination by the organizer:
We may withdraw from the contract if the participant sustainably disturbs the execution of the event/tour regardless of our agreements, or if he behaves contrary to the contract to such an extent that the immediate cancellation of the contract is justified. If a participant is not up to the task of a tour due to a misjudgement, the same applies. We withdraw from the contract up to one week before the start of the trip if a minimum number of participants advertised or officially determined is not reached.

Termination due to force majeure:
If the tour is significantly made more difficult, endangered, impaired or the safety of the customers is no longer guaranteed as a result of unforeseeable force majeure, both you and we can terminate the contract after examining a possible time delay or after proposing an equivalent replacement program. In case of cancellation before the start of the trip for the aforementioned reasons, you will receive the price paid back. There is no further claim. If the aforementioned reasons arise after the start of the trip, the contract can also be terminated by both parties. If the contract is terminated, we may demand appropriate compensation for the services already provided.

Conditions of participation:
Good health and good physical constitution are a prerequisite for the activities. The participant undertakes to inform the organizer about health problems. For all activities related to water, such as canyoning and rafting, all participants must have sufficient swimming skills. Participation in an activity under the influence of drugs and alcohol, psychotropic drugs or the like is not allowed. It is the customer's duty to adhere to the conditions of participation and to strictly follow the instructions of the organizer, guides and auxiliary persons. In case of disregard, the participant can be excluded from the activity. In case of exclusion before the start of the activity, the cancellation policy applies. If the exclusion takes place after the start of the activity, the customer is not entitled to a refund.

Liability, limitations of liability:
We provide the contractually agreed services with the care of a prudent businessman. Participation in all companies is at your own risk, the organizer assumes no liability or we are liable for intent or gross negligence. The fee includes only guided tour and briefing. We limit our liability - regardless of the legal basis - to three times the travel price. We are not liable for service disruptions in connection with services that are merely mediated by us as third-party services. In this case, the travel conditions of the respective organizer are valid.Obligation to cooperateYou are obliged to act in the event of disruptions in performance within the framework of the statutory To cooperate with provisions, to avoid possible damage or to keep them to a minimum. In particular, you are obliged to bring your complaints to the attention of our staff or our staff without delay. We or our staff will endeavor to comply with this complaint as far as possible. If you culpably fail to point out a defect, no claim for reduction of the travel price or compensation arises.

Invalidity of individual provisions:
If one of the provisions of the travel contract is or becomes invalid in whole or in part, this shall not result in the invalidity of the entire travel contract. Rather, we are entitled to replace the invalid provision with the permissible provision that most closely corresponds to the purpose of the invalid provision. Exclusion of claims and statute of limitationsAll claims due to non-contractual provision of the trip must be asserted against us within one month after the contractually intended end of the trip. After expiry of the deadlineyou can assert claims if you have been prevented from complying with the deadline through no fault of your own. All your claims under the travel contract expire in 6 months.The statute of limitations begins on the day on which the event should end according to the contract. If you have asserted such claims, the limitation period is suspended until the day on which we reject the claims in writing.

Applicable law / place of jurisdiction:
Between the customer and the organizer, the law of the Federal Republic of Austria is exclusively applicable. The place of jurisdiction is Lienz in Osttirol.
